COACHING TERMS + CONDITIONS
The Terms + Conditions set out below constitute the legal agreement between the Coaching Client and Alison Ballard relating to the provision of coaching.
1. Description of Coaching
Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and the Coaching Client in a thought-provoking and creative process that inspires the Coaching Client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.
2. Coaching Relationship
A coaching relationship is a partnership between two or more individuals or entities. This relationship is not a legal partnership. Each party must uphold their obligations for the coaching relationship to be successful.
3. Duties + Responsibilities
a. Coaching Client agrees to communicate honestly, be open to feedback and suggestions, and to create the time and energy to commit fully to the coaching process.
b. Coaching Client acknowledges and agrees that coaching is a comprehensive process that may explore different areas of his/her/their life, including work, finances, health and relationships (where relevant), but it is ultimately the Coaching Client’s decision whether to disclose such information about themselves and whether/how they may incorporate coaching into these aspects of their life.
c. Coaching Client is solely responsible for his/her/their own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and interactions with the Coach. As such, the Coaching Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach.
d. Coaching Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
e. Coaching Client is solely responsible for implementing ideas and techniques discovered through coaching.
4. Acceptance of Booking + Invoicing
Alison Ballard has the right to not accept a booking.
When a booking request is made (using the online booking system) you will receive an e-mail reply confirming Alison Ballard has received your booking request. This does not constitute confirmation of your booking.
A booking is confirmed when Alison Ballard issues an invoice, subject to full payment by the specified date shown on the invoice.
FREE coaching sessions are confirmed upon receipt of a confirmation email from Alison Ballard.
5. Payment
Fees must be paid in full before coaching sessions can begin (unless otherwise agreed in advance by Alison Ballard).
Alison Ballard has the right to refuse coaching if the fee is not paid on time (as specified in the invoice).
For block bookings (e.g. blocks of 4 or 6 coaching sessions) all fees must be paid in full before the first coaching session begins (unless otherwise agreed in advance by Alison Ballard).
6. Cancellation Policy
Amendments or cancellations made by the Coaching Client must be made no later than 7 days in advance, using the online booking system. Alison Ballard reserves the right to charge the Coaching Client in full for a late cancellation or missed session.
Alison Ballard has the right to amend or cancel coaching sessions at any time. Any sessions that need to be cancelled (rather than rescheduled) will be reimbursed in full. Liability will be limited to the value of fees paid.
7. Confidentiality
This coaching relationship, as well as all information (physical or verbal) that the Coaching Client shares with Alison Ballard as part of the coaching relationship, is confidential. The Coach agrees not to disclose any information pertaining to the Coaching Client without the Coaching Client’s written consent.
BE ADVISED: The Coach-Client relationship is not a relationship protected by legal confidentiality (like doctor-patient or attorney-client). As such, Alison Ballard could be required to divulge otherwise confidential information to authorities.
Alison Ballard deals with all matters relating to you and your affairs in the strictest confidence unless you ask Alison Ballard to talk with another party on your behalf or to set up a useful introduction for you, or there is evidence of abuse, neglect, or threat of harm to yourself or to someone else.
8. Limited Liability
Alison Ballard makes no guarantees, representations or warranties of any kind or nature, expressed or implied, with respect to the coaching services negotiated, agreed upon, and rendered. In no event shall Alison Ballard be liable to the Coaching Client for any indirect, consequential, or special damages. Notwithstanding any damages that the Coaching Client may incur, Alison Ballard’s entire liability under this Agreement, and the Coaching Client’s exclusive remedy, shall be limited to the amount actually paid by the Coaching Client to Alison Ballard under this Agreement for all coaching services rendered through and including the termination date. The Coaching Client agrees that Alison Ballard is not liable or responsible for any actions or inactions, or for any direct or indirect result of any services provided by the Coach.
9. Applicable Law
This Agreement is governed and construed in accordance with the laws of England and Wales.
Both Parties agree to the terms and conditions set forth above.
